National Bank iBank is a National Bank Online Banking enhancement which allows you to use a condensed version of The National Bank Online Banking system on your iPhone, iPod Touch or iPad ("National Bank iBank"). This service is enabled through an application available via the Apple App Store.
These Conditions of Use form a legal contract between you, the account owner and us, The National Bank of New Zealand, part of ANZ National Bank Limited in relation to your use of National Bank iBank. It is important that you read and understand them before using National Bank iBank as your use of National Bank iBank signifies your acceptance of them.
National Bank iBank is available for registered National Bank Online Banking customers only. The Online Banking Conditions of Use apply to National Bank iBank, together with the additional conditions set out below. Where inconsistent, these Conditions of Use will override The National Bank Online Banking Conditions of Use.
In order to use National Bank iBank you will need either a 3G enabled iPhone with the iPhone with the iOS 4.0 software (or greater), or an iPod touch with iOS 4.0 software (or greater), or an iPad with iOS 3.2 software (or greater) that is enabled for wireless Internet connection ("Mobile Device").
National Bank iBank is a condensed version of Online Banking and therefore the functionality of National Bank iBank is limited to viewing your account balances, making Bill Payments, One-off Payments and transferring funds and reviewing a summary of up to one month's transactions on your accounts. We will not be responsible for any inability of your Mobile Device to access or use National Bank iBank, or for any loss or damage to your Mobile Device resulting from your access or use, or attempted access or use, of National Bank iBank (including downloading any associated applications for National Bank iBank), and you should satisfy yourself as to these matters before attempting to access or use National Bank iBank.
We will not be liable for any loss arising from your use of National Bank iBank, including loss arising from any security breach, if you have acted fraudulently (either alone or together with any other person), or if you have caused or contributed to that loss, for example by failing to comply with any of these Conditions of Use.
You agree to indemnify and hold us harmless for any loss or damage suffered by us, our customers or a third party or for any claim or action which may be brought against us by a customer or third party which results from your misuse of National Bank iBank. This includes any failure by you to ensure that steps are taken to prevent unauthorised use of National Bank iBank.
You acknowledge that any unauthorised reproduction by you of any proprietary information provided or available via National Bank iBank or any portion of it may result in legal action being taken.
We will provide an National Bank iBank Helpdesk to assist you in your use of National Bank iBank. The Helpdesk will be available 24 hours, 365 days a year on 0800 22 82 82. This service is provided on the condition that neither we nor our employees will be liable for any direct or indirect loss suffered by you, resulting from your use of the Helpdesk service.
The Helpdesk will not be responsible for providing advice specific to your Mobile Device, including data connections, cellular charges to your Mobile Device accounts.
The provision and subsequent use of National Bank iBank is subject to the reliability and availability of third party service providers including software providers and network service providers. ANZ National Bank Limited will not be liable for any direct or indirect loss suffered by you, as a result of a reduced level of service caused by any third party.
Using National Bank iBank will not incur any additional fees charged by ANZ National Bank Limited. However, you may incur charges from your mobile operator for downloading and usage of National Bank iBank. Any such charges are your sole responsibility and any matters regarding these charges should be raised with your mobile service provider.
We may at any time modify, add to or delete any of the National Bank iBank or any of these Conditions of Use. We will give you at least 14 days notice of such changes, but we don't have to give you prior notice if we are varying an interest rate, or we are varying a term that is subject to market fluctuations.
We may notify you of termination or suspension of your access to National Bank iBank or any other matter, in writing or by a call or message to your telephone or Mobile Device.
We may notify you of amendments to these Conditions of Use or Online Banking services for your iPhone, iPod Touch or iPad by any of the following means:
In relation to these Conditions of Use, no delay or failure to act will be construed as a waiver of or in any way prejudice, any of our rights. No waiver will be effective unless it is in writing. A waiver of a breach will not waive any other breach.
If any of these Conditions of Use is held to be invalid, illegal or unenforceable, that Condition will be severed and the remaining Conditions of Use will be enforceable.
These Conditions of Use and the contract between you and us arising out of your use of National Bank iBank are governed by New Zealand law and New Zealand courts have jurisdiction.
